Methamphetamine Manufacture

The criminal manufacture of methamphetamines is defined as child abuse when it is done under any of the following circumstances:

  • A child is present

  • It is manufactured in a child's home, on the premises of a child's home, or in a motor vehicle on the premises of a child's home

  • It is manufactured under any other circumstances where a reasonable person should have known that the manufacture would be seen, smelled, or heard by a child

Meth Manufacture Scenarios

1) You notice Ella, a young person at your 4-H Super Saturday event where you are the volunteer event coordinator. She seems to have a chronic cough and congestion. You approach Ella and ask her if she is feeling ok. Ella says she is alright. A while later you notice she is sitting down and does not look well. Again you ask Ella if she is ok, this time she confides in you she hasn't felt well for some time. At this time you also notice skin irritation and redness on her arms. Through some general questions Ella tells you that at her home her mom and dad cook some things in their garage, which is right next to her bedroom, that make her feel sick.

It is reasonable to think that Ella's well-being is being affected by what appears to be methamphetamines being manufactured. If there is a reasonable doubt that these are being manufactured in a child's home or on the premises a report needs to be made.

2) Dustin, is a young man who loves to participate in Garden Club. You have noticed that he has not been coming to sessions. You, as the UW-Extension volunteer, approach him and ask why he has not been able to participate. He is extremely irritable and tells you he is probably going to quit. You ask why and he says he has some things going on at home. He then confides that his 19 year old brother has been keeping him up late at night asking him to help with some "science experiments" in his room. You ask more questions to find out that these experiments have the resemblance of manufacturing methamphetamines.

Yes. Dustin is being asked to do something he does not understand, and while we do not fully know what the "science experiment" is, there is reasonable doubt that it is drug related. Even though this is being done by Dustin's brother, he is 19 and is manufacturing methamphetamines when a child is present and needs to be reported.
